filed. suspected boston bomber dzhokhar tsarnaev was charged today with a weapon -- using a weapon of mass destruction and malicious destruction of property resulting in death following three deaths and 180 injured in last week's marathon attack. the criminal complaint includes the description of footage of him leaving a knapsack on the ground where the explosion took place. another similar bomb was found at the site of the watertown shootout. tsarnaev remains in a boston hospital tonight unable to speak because of injuries that include a gunshot wound to his neck. but he's being questioned by authorities already and responding with written answers. in medford, massachusetts, today a funeral was held for 29-year-old victim krystle campbell. in boston, deval patrick and mayor menino requested a moment of silence at 2:50 to mark the one-week anniversary of the bombing. great public servants up there. we begin with those new charges filed against dzhokhar tsarnaev. pete william is nbc's chief justice correspondent. pete, we have charges. >> we do. couple things about the charges. both of

suspects. we learned the older brother, dzhokhar tsarnaev, bought two mortar kits in february from a new hampshire store that contained up to 1.5 pound of gunpowder not enough to detonate the bombs. the surviving brother, dzhokhar tsarnaev, has been upgraded to "fair" and telling investigators he and his brother devised the attack from the intent and they had no direction or financing from government or rogue groups. dzhokhar tsarnaev was discovered in a backyard boat after a shootout with police. in an interview with abc7 news, the boat owner describes finding him. >> i know i took three steps up the dadder, i don't remember stepping down off the ladder. this hits you after when you think, my god, we could have...i don't know...it is surreal. >> according to the new york news people donated $10,000 to buy him a new boat but the money would be better spent on victim charities. one victim, m.i.t. police officer collier, will have a memorial service this morning, and vice president bide and his wife will be there at m.i.t. canceled classes today. lawmakers are asking tough questions

today against 19-year-old dzhokhar tsarnaev, the surviving suspect in the boston marathon bombing. and this ten-page criminal complaint is big news for two reasons. it's news for the incredible details of the allegations contained within it, and it is news because of the simple fact that it exists. let's start with the news. the complaint describes in heart stopping detail exactly what authorities -- of the bombing itself. quote, approximately 30 seconds before the first explosion, dzhokhar tsarnaev lifts his phone to his ear as if he is speaking on his cell phone and keeps it there for approximately 18 seconds. a few seconds after he finishes the call, the large crowd of people around him can be seen reacting to the first explosion. virtually every head turns to the east towards the finish line and stares in that direction in apparent bewilderment and alarm. dzhokhar appears calm. he glance to the east and calmly begin but rapidly begins moving to the west. he walks away without his knapsack, having left it on the ground where he had been standing. approximately ten seconds later

dzhokhar tsarnaev is talking or at least communicating, big new developments this morning in the boston marathon bombing investigation. cnn's jake tapper has learned that tsarnaev is communicating with investigators, and claims that he and his brother pulled off last week's bombing of the marathon and also that their motivation seems to be that of jihadists. cnn's chief washington correspondent and anchor of "the lead" jake tapper is with us this morning. and jake, what are your sources telling you about these communications. >> u.s. government source tells me that in these preliminary interviews with dzhokhar tsarnaev, and he underlines they're preliminary, all the information that dzhokhar is giving needs to be checked out, that investigators are not taking his word for it, but what he is saying is that first of all, there were no foreign groups involved in the attacks. second, he's saying that there is an online component to how these brothers were radicalized. they watched videos online. they got information online. there doesn't seem to be any communication, any e-mail with

dagestan. we have further information about dzhokhar tsarnaev. here here in boston in the hospital after he suffered massive blood loss. that's where we find pamela brown this morning. what have we learned? >> reporter: we are learning new information this morning. we learned from a department of justice official that federal prosecutors have been here at the hospital since last night figuring out possible charges to bring forward and we're learning from that official that those charges will be coming soon even possibly while the suspect is still here at the hospital. now, we don't know the extent of the charges that will be brought forward but according to the doj official, the suspect will face terrorism charges. he is in federal custody. he will be charged with federal charges and he could face murder charges on the state level. now interesting to note here, there is no death penalty here in the state of massachusetts but the death penalty could be sought on the federal level since that supersedes state charges. no charges have been brought forward yet but we're hearing from a departm

now let us know that this bombing suspect, dzhokhar tsarnaev is not -- i repeat, is not going to be treated as an enemy combatant. there have been a lot of questions about just what kind of prosecution this young man is going to be facing whether it would be in civilian justice or perhaps would he be one of those considered for prosecution in a military tribunal, perhaps even at guantanamo bay, but there you have it straight from the white house he will not be treated as an enemy combatant. the court and justice itself for boston and for the nation may well depend on exactly what those interactions are right now going on between dzhokhar tsarnaev and the high value detainee interrogation group. again, that's a very frightening sounding group, but the high value detainee interrogation group is comprised of a number of officials of the cia, the fbi and others. those very well may be the people who are at that hospital bedside periodically asking whatever questions they can get out of this suspect. i want to get into some of that right now with three of the smartest in the business. th
